What we resolve

The decisions that change the outcome of an investment are taken before the offer. These are the ones we take with you.

  • The purchase structure: personally, through a Spanish or foreign company, or with several buyers; and what each option means for tax, liability and succession.
  • Taxation of the transaction and of ownership: ITP or VAT on purchase, non-resident income tax, wealth tax, and the future sale.
  • Holiday lettings: the tourist-use dwelling registration in Andalusia, community and planning restrictions in Marbella, and contracts with managers and platforms.
  • Land and development: planning due diligence, agreements with the Town Hall, licences, construction contracts and off-plan sales with their guarantees.
  • Financing: negotiation of the mortgage with the lender, developer loan terms and security.
  • The exit: preparing the asset for sale, taxation of the gain and retentions.

Marbella holds part of the most active luxury market in Europe, and that attracts good deals and haste in equal measure. Our job is to keep haste out of the decision: land that cannot be built on, a licence that does not exist or a community that bans holiday lettings changes the value of an investment overnight. We measure it first.

What clients ask us.

Is it better to buy personally or through a company?

It depends on what you will do with the property, where you are tax resident and how you intend to pass it on. A company does not always save tax and adds running costs; sometimes it pays, sometimes it does not. We run the numbers before deciding.

Can I let my Marbella home to holidaymakers?

In Andalusia the property must be registered as a tourist-use dwelling and meet its requirements. The community’s by-laws may also restrict or ban it, and municipal planning may impose conditions. This is checked before buying, not after.

Does the Golden Visa for buying property still exist?

No. The investor residence visa for property purchases stopped being granted on 3 April 2025. Other residence routes that do not depend on a purchase still exist, and we can point you to the right specialist.

What taxes does a non-resident pay for owning property in Spain?

Non-resident income tax, whether you let it (on the rent) or not (on a deemed income), the municipal IBI and, depending on value, wealth tax. On sale, the gain is taxed under non-resident tax and the buyer withholds 3 % of the price on account.
